Considerações sobre o tema do Biodireito frente a filosofia e a teologia

 

 

Introdução

 

         Ao tratar de um tema amplo e complexo, o cuidado com as noções, conceitos e afirmações requerem redobrada atenção. O scholar dispõe de conhecimento na área de filosofia e teologia e adentra na área jurídica sem lhe poupar o zelo e o cuidado tanto hermenêutico quanto exegético.

            Uma Obra tornou-se fulcro para a análise do ponto de vista filosófico e jurídico, a saber, Legalität und Legitimität (1932) de Carl Schmitt, obra esta que fará juntada como subsídio bibliográfico para melhor e mais rigorosa fundamentação das idéias aqui defendidas. Com Schmitt pretendo de imediato distanciar as idéias de legalidade e legitimidade, compreendendo as idéias da igreja como legítimas em contextos históricos e em dados momentos legais, quando estado e religião fundiam-se, todavia, após a publicação das 95 teses de Martinho Lutero, afixadas na porta da capela de Wittemberg em 31 de outubro de 1517, considero marco inicial de contestação à ordem tida como legal da Igreja Católica.

            Lutero, também fundador de organização religiosa, questiona a legalidade das ações da igreja da qual fez parte, especialmente na Tese de nº 90, verbis:

“Diese äußerst peinlichen Einwände der Laien nur mit Gewalt zu unterdrücken und nicht durch vernünftige Gegenargumente zu beseitigen heißt, die Kirche und den Papst dem Gelächter der Feinde auszusetzen und die Christenheit unglücklich zu machen.”Fonte :19 de janeiro de 2012 às 15h30 http://www.ekd.de/glauben/95_thesen.html

            Em alto nível, compreender-se-á que a Lei, sendo legítima, oriunda da vontade do Legislador, encontra amparo no Ordenamento Jurídico, cabendo aos doutrinadores do Direito, avaliações e pontos de vistas, cabe aqui o cumpra-se da teoria pura do Direito. Carl Schimitt, sem nenhum juízo de valor quanto a sua consciência política por parte deste scholar, bem soube interpretar o pensamento de Thomas Hobbes (1578-1679) em duas de suas principais Obras: O Leviatã de 1651 e De Cive também do mesmo ano. Esta última Obra, traduzida para o português com o título de O Cidadão,apresenta claramente o pensamento pós-reforma luterana levando Hobbes a discutir as relações entre Estado e Igreja. A famosa frase Homo homini lupus, utilizada por Hobbes , todavia, de autoria de Tito Mácio Plauto (230- 180 a.C) e ipsi litteris grafada assim por Plauto: "Lupus est homo homini non homo", sustenta a tese de que o homem necessita de um Ordenamento Jurídico calcado na legalidade e em uma formatação positivada.

            Michel Foucault ( 1926-1984) , filósofo francês, entre suas Obras contestadoras tanto quanto à igreja e quanto à utilização do saber jurídico pelas classes formadoras do saber, torna-se figura essencial neste debate, especialmente no seu livro  Vigiar e Punir (1975), e sua brilhante análise sobre os corpos dóceis no excelente capítulo VII da Obra citada.

            Antes de entrar no mérito da análise do que é correto e legal e ainda legítimo, cabe pensar Foucault e sua velha questão levantada: “A quem pertence o corpo ?”, essa é a fragrância do Vigiar e Punir . Maximizo a questão: “A quem pertence o corpo da mulher ?”. Entre todos os assuntos polêmicos, a mulher ao longo dos milhares de séculos, sequer é detentora do seu próprio corpo e de sua res extensa"corporeal substance" a lembrar Descartes.

            A polêmica com relação à Lei 11.105/05 que levou a Suprema Corte a julgar a ADI 3510/600, revelou de imediato a preocupação com o uso ético da manipulação genética de embriões humanos, esqueceu-se, todavia, que em pleno século XXI,  a mulher sequer pode escolher o que fazer com seu próprio corpo, outrora foi assim e a igreja assume a responsabilidade decisória sobre a legitimidade de suas idéias e dogmas, todavia, a legalidade é alçada que não lhe compete mais, esperamos.

            Rose Marie Muraro em breve introdução histórica ao “Malleus Maleficarum” diz-nos o seguinte:

“Ao contrário da mulher, que possuía o “poder biológico”, o homem foi desenvolvendo o “poder cultural” à medida que a tecnologia foi avançando. Enquanto as sociedades eram de coleta, as mulheres mantinham uma espécie de poder, mas diferente das culturas patriarcais. Essas culturas primitivas tinham de ser cooperativas, para poder sobreviver em condições hostis , e portanto não havia coerção ou centralização, mas rodízio de lideranças, e as relações entre homens e mulheres eram mais fluídas do que viriam a ser nas futuras sociedades patriarcais”. ( Op. cit. p.6) Eu grifei.

 

            A palavra coerção grifada no texto supra, nos leva a crer que não existia uma concepção de LEI como a entendemos a partir da Lei das XII Tábuas, da Torá judaica, do Código de Hamurabi etc. Muraro remete este período a antes do neolítico antes das primeiras idéias de mytho ou teogonias.

            As religiões hodiernas são antagônicas com relação ao papel da mulher em seus ritos, ou mistificam-nas ou as fustigam sob pesados dogmas. Nesta introdução, pretendemos antes de analisarmos penosamente , como de fato é necessário, o papel da igreja frente ao real do mundo, refletirmos que as causas mais delgadas nos últimos 3 milênios com relação à LEGIS foi o papel da mulher frente ao simbolismo religioso e a extraordinária dominância patriarcal do Império Romano com a figura do Paeter Familiae.

            A escolha de Carl Schmitt para o debate entre a legitimidade e a legalidade que travaremos abaixo em momento oportuno, dá-se propositalmente pelo fato do controverso pensador alemão ser declaradamente católico, ainda por seus fundamentos políticos possuírem como pilares as idéias de Nicolau Maquiavel, Thomas Hobbes, Jean-Jacques Rousseau entre outros. A rigidez normativa jurídica alemã de Schmitt, fulcro do nazismo, é comparada à Inquisição dos séculos XVI e XVII no dizer de Carlos Amadeu B. Byington, médico psquiatra e analista, membro da Sociedade de Psicologia Analítica e que prefacia o “Malleus Maleficarum” com excelente texto intitulado: “Uma teoria simbólica da história”.

            Em tempo, lembramos as palavras da ministra e presidente do STF na época do julgamento da ADI 3510/600, Ellen Gracie Northfleet , em que dizia: “Esta casa não é uma Academia de ciências”. Parafraseio a eminente ministra e mulher, com a seguinte frase: “A igreja não é um tribunal”, ao menos, em um Estado Democrático de Direito.

 

I-             A Fé

 

As questões que envolvem a Fé ou Credo de uma instituição religiosa, costumam ser polêmicas. A igreja não é a última palavra em assuntos que envolvam códigos e preceitos positivados pelo modelo do barão de Montesquieu, a tripartição dos poderes constituídos(Executivo, legislativo e judiciário) e que geram o Estado. Antes de Montesquieu , Hobbes em seu “Do Cidadão” afirma:

“Alguém talvez se admire, de que há hoje tantos parágrafos de fé (todos de tal modoconsiderados de fé que, se o indivíduo não acreditar neles interiormente, não poderá entrar no reinodos céus), quando, à parte o parágrafo que Jesus é o Cristo, necessário à salvação e consentido comfé interior, todos os demais se referem só à obediência, que decerto pode ser prestada, mesmo sealguém não tem fé interior (bastando desejar, crer e professar exteriormente, sempre que necessário)em tudo que a igreja propõe. Mas se considerarmos que na maior parte das controvérsias a luta estáem torno do poder dos homens; em algumas outras, do ganho; em outras, do prestigio intelectual —teríamos então menos do que nos admirar.” (Do Cidadão- p.168).

 

            Os dogmas e credos e decisões religiosas, sejam de qual segmento for, devidamente constituidos, são legítimos, todavia, não necessariamente legais, pois em um Estado Democrático de Direito, o modelo democrático e positivado devem expressar a vontade do povo. Carl Schmitt afirma:

“El problema de las relaciones entre religión y política se presenta desde los albores de la Historia en múltiples formas, pues la analogía entre el gobierno divino y el de los hombres viene dado como algo obvio a la conciencia humana. Sin embargo, cuando hoy hablamos de «teología política» nosreferimos a un planteamiento más concreto de la fundamentación tomada de la ciencia de la divinidad para justificar determinadas formas políticas contingentes, y no a cualquier manifestación de apoyatura de lo político en lo sagrado o cualquier forma político-religiosa mixta o mixtificada. Aun así, el concepto de teología política no sé presenta hoy con suficiente nitidez, y esta misma equivocidad puede explicar en buena parte la discusión surgida en torno a ese concepto.” (Teologia política, p. 1)

 

            Os Estados Unidos da América, berço do federalismo de 1787, em uma ação movida por um membro de uma instituição religiosa conhecida por “Testemunhas de Jeová”, contrários veementemente à transfusão de sangue entre seus seguidores, mesmo em casos extremos, possuem largo histórico de pleitos judiciais entre seus membros e o Estado. Em 1986 um Tribunal Federal julgou-se incompetente para julgar questões de fé, por entender lesão à 1ª Emenda da Constituição americana se o fizessem. A queixosa tentou recorrer em 1987 à Suprema Corte e teve seu pedido negado, em decorrência do mesmo entendimento.

REINHARDT, Circuit Judge:

Janice Paul, a former member of the Jehovah's Witness Church, appeals from the grant of summary judgment in favor of defendants, the corporate arms of the Governing Body of Jehovah's Witnesses. Paul contends that she is being "shunned" by adherents of the Jehovah's Witness faith. She initially filed suit in state court, setting forth various tort claims. Defendants removed the action on the ground of diversity. Because the practice of shunning is a part of the faith of the Jehovah's Witness, we find that the "free exercise" provision of the United States Constitution and thus of the Washington State Constitution precludes the plaintiff from prevailing. The defendants have a constitutionally protected privilege to engage in the practice of shunning. Accordingly, we affirm the grant of summary judgment, although for reasons different from those of the district court. See generally Anderson v. Liberty Lobby, Inc., --- U.S. ----, 106 S.Ct. 2505, 91 L.Ed.2d 202 (1986).

I. Facts

Janice Paul was raised as a Jehovah's Witness. Her mother was very active in the Church and, from the age of four, Paul attended church meetings. In 1962, when Paul was 11 years old, her mother married the overseer of the Ephrata, Washington congregation of Jehovah's Witnesses. In 1967, Paul officially joined the Witnesses and was baptized.

According to Paul, she was an active member of the congregation, devoting an average of 40 hours per month in door-to-door distribution of the Witnesses' publications. In addition to engaging in evening home bible study, she attended church with her family approximately 20 hours per month. She eventually married another member of the Jehovah's Witnesses.

In 1975, Paul's parents were "disfellowshiped" from the Church. According to Paul, her parents' expulsion resulted from internal discord within their congregation. The Elders of the Lower Valley Congregation told Paul that she and her husband should not discuss with other members their feeling that her parents had been unjustly disfellowshiped. That advice was underscored by the potential sanction of her own disfellowship were she to challenge the decision.

Sometime after the Elders' warning, Paul decided that she no longer wished to belong to the congregation, or to remain affiliated with the Jehovah's Witnesses. In November 1975, Paul wrote a letter to the congregation withdrawing from the Church.

The Witnesses are a very close community and have developed an elaborate set of rules governing membership. The Church has four basic categories of membership, non-membership or former membership status; they are: members, non-members, disfellowshiped persons, and disassociated persons. "Disfellowshiped persons" are former members who have been excommunicated from the Church. One consequence of disfellowship is "shunning," a form of ostracism. Members of the Jehovah's Witness community are prohibited--under threat of their own disfellowship--from having any contact with disfellowshiped persons and may not even greet them. Family members who do not live in the same house may conduct necessary family business with disfellowshiped relatives but may not communicate with them on any other subject. Shunning purportedly has its roots in early Christianity and various religious groups in our country engage in the practice including the Amish, the Mennonites, and, of course, the Jehovah's Witnesses.

"Disassociated persons" are former members who have voluntarily left the Jehovah's Witness faith. At the time Paul disassociated, there was no express sanction for withdrawing from membership. In fact, because of the close nature of many Jehovah's Witness communities, disassociated persons were still consulted in secular matters, e.g. legal or business advice, although they were no longer members of the Church. In Paul's case, for example, after having moved from the area, she returned for a visit in 1980, saw Church members and was warmly greeted.

In September 1981, the Governing Body of Jehovah's Witnesses, acting through the defendants--Watchtower Bible and Tract Society of Pennsylvania, Inc., and the Watchtower Bible and Tract Society of New York, Inc.--issued a new interpretation of the rules governing disassociated persons. The distinction between disfellowshiped and disassociated persons was, for all practical purposes, abolished and disassociated persons were to be treated in the same manner as the disfellowshiped. The September 15, 1981 issue of The Watchtower, an official publication of the Church, contained an article entitled "Disfellowshiping--how to view it." The article included the following discussion:

THOSE WHO DISASSOCIATE THEMSELVES

... Persons who make themselves 'not of our sort' by deliberately rejecting the faith and beliefs of Jehovah's Witnesses should appropriately be viewed and treated as are those who have been disfellowshiped for wrongdoing.

The Watchtower article based its announcement on a reading of various passages of the Bible, including 1 John 2:19 and Revelations 19:17-21. The article noted further that "[a]s distinct from some personal 'enemy' or worldly man in authority who opposed Christians, a ... disassociated person who is trying to promote or justify his apostate thinking or is continuing in his ungodly conduct is certainly not one to whom to wish 'Peace' [understood as a greeting]. (1 Tim. 2:1, 2)." Finally, the article stated that if "a Christian were to throw in his lot with a wrongdoer who ... has disassociated himself, ... the Elders ... would admonish him and, if necessary, 'reprove him with severity.' " (citing, inter alia, Matt. 18:18, Gal. 6:1, Titus 1:13).

Three years after this announcement in The Watchtower, Paul visited her parents, who at that time lived in Soap Lake, Washington. There, she approached a Witness who had been a close childhood friend and was told by this person: "I can't speak to you. You are disfellowshiped." Similarly, in August 1984, Paul returned to the area of her former congregation. She tried to call on some of her friends. These people told Paul that she was to be treated as if she had been disfellowshiped and that they could not speak with her. At one point, she attempted to attend a Tupperware party at the home of a Witness. Paul was informed by the Church members present that the Elders had instructed them not to speak with her.

Upset by her shunning by her former friends and co-religionists, Paul, a resident of Alaska, brought suit in Washington State Superior Court alleging common law torts of defamation, invasion of privacy, fraud, and outrageous conduct. Defendants, Watchtower Bible and Tract Associations, removed the action to federal court pursuant to 28 U.S.C. Sec. 1441 (1982). Watchtower moved to dismiss for lack of subject matter jurisdiction and for failure to state a claim under Washington law. Fed.R.Civ.P. 12(b)(1) & (6). In the alternative, Watchtower sought summary judgment. Fed.R.Civ.P. 56(b).

The district court denied the 12(b)(1) motion to dismiss for lack of subject matter jurisdiction and the 12(b)(6) motion to dismiss for failure to state a claim, but granted the motion for summary judgment. The court ruled that it had jurisdiction over the case because the state court properly had jurisdiction originally. See Salveson v. Western States Bankcard Ass'n, 731 F.2d 1423, 1431 (9th Cir.1984). The court also held that Paul's affidavits did not set forth facts that would establish a prima facie case for relief. Moreover, the court ruled that even if the practice of shunning was actionable, the court was prohibited from ruling on the issue on the ground of ecclesiastical abstention. That doctrine prohibits courts from determining issues of canon law. See generally Serbian Eastern Orthodox Diocese v. Milivojevich, 426 U.S. 696, 96 S.Ct. 2372, 49 L.Ed.2d 151 (1976).1

II. The Plaintiff's Cause of Action

Janice Paul seeks relief against the Church and several Church officials under Washington state law and pleads various causes of action in tort. She claims in essence that the practice of shunning invades interests that the state does or should protect through its tort law.

The case is properly before the federal courts because of our diversity jurisdiction. See 28 U.S.C. Secs. 1332 & 1447. When federal courts sit in diversity, we apply state law. Erie R.R. v. Thompkins, 304 U.S. 64, 58 S.Ct. 817, 82 L.Ed. 1188 (1938). Our task is complicated by the fact that there are no Washington cases considering whether a cause of action in tort exists against a church for "shunning" a former member or for engaging in comparable religious practices, although the applicability of state tort law to church practices has been the subject of recent litigation in other jurisdictions. See Annotation, Liability of Religious Association for Damages for Intentionally Tortious Conduct in Recruitment, Indoctrination, or Related Activity, 40 ALR 4th 1062 (1985); Miller v. Catholic Diocese of Great Falls, 728 P.2d 794 (Mont.1986).

We note at the outset that in this case the actions of Church officials and members were clearly taken pursuant to Church policy. Cf. Van Schaick v. Church of Scientology of California, 535 F.Supp. 1125, 1142 (D.Mass.1982) (noting plaintiff's "burden to show that the actions taken against her by individual church members were taken pursuant to some Church policy, practice or directive"). Although shunning is intentional, the activity is not malum in se. The state is legitimately concerned with its regulation only to the extent that individuals are directly harmed.

One state has recently recognized a cause of action in tort arising from the practice of shunning. Although it did not purport to create a new tort, the Supreme Court of Pennsylvania, in Bear v. Reformed Mennonite Church, 462 Pa. 330, 341 A.2d 105 (1975), noted that certain interests protected by the state may be invaded when shunning occurs. As the Court stated:

the "shunning" practice of appellee church and the conduct of the individuals may be an excessive interference within areas of "paramount state concern," i.e. the maintenance of marriage and family relationship, alienation of affection, and the tortious interference with a business relationship....

Id. at 107.

 

Under Washington tort law there are at least three basic categories of intentional conduct that are relevant here: conduct causing emotional distress, conduct causing alienation of affections, and conduct causing harm to reputation. Paul claims to have suffered injuries in all three categories as a result of the intentional actions of the Jehovah's Witnesses. Under Washington law, "intangible-emotional" harm is, at least in some circumstances, sufficient to support a claim in tort. See Wilson v. Lund, 80 Wash.2d 91, 98, 491 P.2d 1287, 1291 (1971) (" 'intangible-emotional' injuries can and do constitute real and significant harms ") (emphasis in original) (permitting damages for loss of love and companionship of dead child and for injury to or destruction of parent-child relationship); cf. Baugh v. Thomas, 56 N.J. 203, 265 A.2d 675, 677 (N.J.1970) ("We believe that expulsion from a church or other religious organization can constitute a serious emotional deprivation which, when compared to some losses of property or contract rights, can be far more damaging to an individual.").

Federal courts are not precluded from affording relief simply because neither the state Supreme Court nor the state legislature has enunciated a clear rule governing a particular type of controversy. Were we able to invoke only clearly established state law, litigants seeking to protect their rights in federal courts by availing themselves of our diversity jurisdiction would face an inhospitable forum for claims not identical to those resolved in prior cases. Equally important, a policy by the federal courts never to advance beyond existing state court precedent would vest in defendants the power to bar the successful adjudication of plaintiffs' claims in cases with novel issues; defendants could ensure a decision in their favor simply by removing the case to federal court. Congress, in providing for removal, certainly did not intend to provide such a weapon to defendants.

Nonetheless, we need not decide here whether Washington courts would ultimately rule that Paul has set forth a prima facie claim for relief in tort because the defendants, in any event, possess an affirmative defense of privilege--a defense that permits them to engage in the practice of shunning pursuant to their religious beliefs without incurring tort liability. Were shunning considered to be tortious conduct, the guarantee of the free exercise of religion would provide that it is, nonetheless, privileged conduct. In theory, we could examine the question whether the shunning of a former member of a church is, in itself, tortious; however, we will follow the practice of Washington courts which safeguard the free exercise of religion through the recognition of substantive defenses to torts, rather than by negating the plaintiff's cause of action itself (i.e. ruling that the conduct in question is not tortious). See Carrieri v. Bush, 69 Wash.2d 536, 419 P.2d 132, 137 (1966). The Washington practice, in addition to being the governing rule here is, in our view, the most sensible juridical approach. See New York Times v. Sullivan, 376 U.S. 254, 84 S.Ct. 710, 11 L.Ed.2d 686 (1964).

III. The Defendants' Privilege

Shunning is a practice engaged in by Jehovah's Witnesses pursuant to their interpretation of canonical text, and we are not free to reinterpret that text.2 Under both the United States and Washington Constitutions, the defendants are entitled to the free exercise of their religious beliefs. As the Washington Supreme Court has stated, "[t]here is no question that our state constitution protects the free exercise of religious beliefs (Const. art. 1, Sec. 11 (amendment 34))." Carrieri v. Bush, 69 Wash.2d 536, 419 P.2d 132, 137 (1966).

The free exercise protections of the Washington Constitution are at least as generous as those of the federal constitution. Indeed, in a decision rendered last year, the Washington Supreme Court relied exclusively on federal precedent in interpreting the scope of the free exercise protections of its constitution, noting that the "parties have not argued persuasively for a different application of the provisions of the First Amendment and Const. art. 1, Sec. 11 (amend. 34) of the State Constitution as they pertain to the [free] exercise of religion." Backlund v. Board of Comm'rs of King County Hosp., 106 Wash.2d 632, 639 n. 3, 724 P.2d 981, 985 n. 3 (1986). The parties here also do not suggest any dissimilarity between the free exercise provisions of the two constitutions. Accordingly, we too will assume that they are identical and will base our conclusion as to the meaning of the Washington Constitutional provisions on our understanding of the parallel provision of the First Amendment. Cf. Examining Bd. of Eng's v. Flores de Otero, 426 U.S. 572, 597-98, 96 S.Ct. 2264, 2278-79, 49 L.Ed.2d 65 (1976).3

State laws whether statutory or common law, including tort rules, constitute state action. In New York Times Co. v. Sullivan, 376 U.S. 254, 84 S.Ct. 710, 11 L.Ed.2d 686 (1964), the Supreme Court ruled that state libel laws are subject to the constraints of the first amendment. "The test," according to the Court, "is not the form in which state power has been applied but, whatever the form, whether such power has in fact been exercised." 376 U.S. at 265, 84 S.Ct. at 718. See also Lugar v. Edmondson Oil Co., Inc., 457 U.S. 922, 936-40, 102 S.Ct. 2744, 2753-55, 73 L.Ed.2d 482 (1982); Shelley v. Kraemer, 334 U.S. 1, 68 S.Ct. 836, 92 L.Ed. 1161 (1948); American Fed'n of Labor v. Swing, 312 U.S. 321, 61 S.Ct. 568, 85 L.Ed. 855 (1941). For purposes of this test, we see no difference between libel and other forms of torts. Clearly, the application of tort law to activities of a church or its adherents in their furtherance of their religious belief is an exercise of state power. When the imposition of liability would result in the abridgement of the right to free exercise of religious beliefs, recovery in tort is barred.

The Jehovah's Witnesses argue that their right to exercise their religion freely entitles them to engage in the practice of shunning. The Church further claims that assessing damages against them for engaging in that practice would directly burden that right.

We agree that the imposition of tort damages on the Jehovah's Witnesses for engaging in the religious practice of shunning would constitute a direct burden on religion. The free exercise claim here is unlike the one in Braunfeld v. Brown, 366 U.S. 599, 81 S.Ct. 1144, 6 L.Ed.2d 563 (1960). In Braunfeld, the United States Supreme Court upheld Sunday closing laws even though it acknowledged that Sunday closings made the practice of their religious beliefs more expensive for Saturday Sabbatarians, by forcing them to close their businesses two days a week--Saturday (per religious compulsion) and Sunday (per state compulsion). In upholding the Pennsylvania statute, the Court stated that "to strike down ... legislation which imposes only an indirect burden on the exercise of religion, i.e. legislation which does not make unlawful the religious practice itself, would radically restrict the operating latitude of the legislature." Id. at 606, 81 S.Ct. at 1147.

As the Court analyzed the issues in Braunfeld, the direct burden imposed by the statute--Sunday closing and the financial losses attributable thereto--fell equally on all persons. That the closing, in the end, had a greater adverse impact on Saturday Sabbartarians was, in the Court's view, an indirect result of the fact that members of those religions closed their places of business on Saturdays as well. In the Court's view, the law did not regulate or prohibit Saturday closings, (in which case it would have constituted a direct burden on Saturday Sabbatarians) but only Sunday operations. From this, the Court concluded that the statute did not directly regulate or prohibit a religious practice (Saturday closings) but merely regulated a non-religious one (Sunday business operations); accordingly, any effect on the religious practice was, in the Court's view, "indirect."4

Here, by contrast, shunning is an actual practice of the Church itself, and the burden of tort damages is direct. Permitting prosecution of a cause of action in tort, while not criminalizing the conduct at issue, would make shunning an "unlawful act." Langford v. United States, 101 U.S. (11 Otto) 341, 345, 25 L.Ed. 1010 (1879) ("[T]he very essence of a tort is that it is an unlawful act."). Imposing tort liability for shunning on the Church or its members would in the long run have the same effect as prohibiting the practice and would compel the Church to abandon part of its religious teachings. Were we to permit recovery, " 'the pressure ... to forego that practice [would be] unmistakeable,' " Thomas v. Review Board, 450 U.S. 707, 717, 101 S.Ct. 1425, 1431, 67 L.Ed.2d 624 (1981) (quoting Sherbert v. Verner, 374 U.S. 398, 404, 83 S.Ct. 1790, 1794, 10 L.Ed.2d 965 (1963)). The Church and its members would risk substantial damages every time a former Church member was shunned. In sum, a state tort law prohibition against shunning would directly restrict the free exercise of the Jehovah's Witnesses' religious faith.5

In Cantwell v. Connecticut, the Supreme Court faced a claim of a direct burden on religion. 310 U.S. 296, 60 S.Ct. 900, 84 L.Ed. 1213 (1940). There, the appellant, also a Jehovah's Witness, was convicted of inciting a breach of the peace. Cantwell had stopped two men on the street and asked their permission to play a phonograph record entitled "Enemies." The record was a general attack on organized religions, in particular the Roman Catholic Church. Upon listening, the two men were highly offended: "one of them said he felt like hitting Cantwell and the other that he was tempted to throw Cantwell off the street." Id. at 309, 60 S.Ct. at 905. Although Cantwell's conduct did not in itself breach the peace, the reaction it produced--and had been likely to produce--was a violation of the law.

In finding the conviction of Cantwell to be barred by the first amendment, the Court recognized that "[i]n every case the power to regulate [religious conduct] must be so exercised as not, in attaining a permissible end, unduly to infringe the protected freedom [of the exercise of religion]." Id. at 304, 60 S.Ct. at 903. The Supreme Court noted that there had been "no assault or threatening of bodily harm." Id. at 310, 60 S.Ct. at 906. It held that the intangible harms caused by the exercise of Cantwell's religious belief were insufficient to justify the imposition of civil or criminal liability. The Court ruled that the state had failed to demonstrate that there was a "clear and present menace to public peace and order as to render [Cantwell] liable to conviction of the common law offense in question." Id. at 311, 60 S.Ct. at 906.

In Sherbert v. Verner, 374 U.S. 398, 83 S.Ct. 1790, 10 L.Ed.2d 965 (1963), the Supreme Court once again struck down a burden on the free exercise of religion. The Court began its analysis by noting that in previous cases where it had upheld the imposition of burdens on the right to exercise religious beliefs freely the "conduct or actions so regulated have invariably posed some substantial threat to public safety, peace, or order." Id. at 403, 83 S.Ct. at 1793. Similarly, the Supreme Court reiterated its view that "[o]nly the gravest abuses, endangering paramount interests, give occasion for permissible limitation." Id. at 406, 83 S.Ct. at 1795 (quoting Thomas v. Collins, 323 U.S. 516, 530, 65 S.Ct. 315, 322, 89 L.Ed. 430 (1945)). More directly, the Court expressed its disapproval of state action similar to that which the plaintiff seeks here: "a fine imposed against appellant for her Saturday worship." Id. at 404, 83 S.Ct. at 1794. In Sherbert, what the Court termed a "fine" was only a denial of public benefits; here, the "fine" is actual money damages.6

We find the practice of shunning not to constitute a sufficient threat to the peace, safety, or morality of the community as to warrant state intervention. The test for upholding a direct burden on religious practices is as stringent as any imposed under our Constitution. Only in extreme and unusual cases has the imposition of a direct burden on religion been upheld. See, e.g., Reynolds v. United States, 98 U.S. (8 Otto) 145, 25 L.Ed. 244 (1878) (polygamy); Hill v. State, 38 Ala.App. 404, 88 So.2d 880 (1956) (snake handling). The harms suffered by Paul as a result of her shunning by the Jehovah's Witnesses are clearly not of the type that would justify the imposition of tort liability for religious conduct. No physical assault or battery occurred. Intangible or emotional harms cannot ordinarily serve as a basis for maintaining a tort cause of action against a church for its practices--or against its members. Cf. West Virginia State Bd. of Educ. v. Barnette, 319 U.S. 624, 646, 63 S.Ct. 1178, 1189, 87 L.Ed. 1628 (1943) (Murphy, J., concurring) ("[T]he benefits that may accrue to society from the compulsory flag salute are [not] sufficiently definite and tangible to justify the invasion of freedom and privacy that is entailed."). Offense to someone's sensibilities resulting from religious conduct is simply not actionable in tort. See Cantwell, 310 U.S. 296, 60 S.Ct. 900; cf. Cohen v. California, 403 U.S. 15, 91 S.Ct. 1780, 29 L.Ed.2d 284 (1971). Without society's tolerance of offenses to sensibility, the protection of religious differences mandated by the first amendment would be meaningless.

A religious organization has a defense of constitutional privilege to claims that it has caused intangible harms--in most, if not all, circumstances.7 As the United States Supreme Court has observed, "[t]he values underlying these two provisions [of the first amendment] relating to religion have been zealously protected, sometimes even at the expense of others interests." Yoder, 406 U.S. at 214, 92 S.Ct. at 1532.

Providing the Church with a defense to tort is particularly appropriate here because Paul is a former Church member. Courts generally do not scrutinize closely the relationship among members (or former members) of a church. Churches are afforded great latitude when they impose discipline on members or former members. We agree with Justice Jackson's view that "[r]eligious activities which concern only members of the faith are and ought to be free--as nearly absolutely free as anything can be." Prince v. Massachusetts, 321 U.S. 158, 177, 64 S.Ct. 438, 445, 88 L.Ed. 645 (1944) (concurring).

The members of the Church Paul decided to abandon have concluded that they no longer want to associate with her. We hold that they are free to make that choice. The Jehovah's Witnesses' practice of shunning is protected under the first amendment of the United States Constitution and therefore under the provisions of the Washington state constitution.

IV. Conclusion

We affirm the district court's grant of summary judgment in favor of the defendants, Watchtower Bible Societies of New York and Philadelphia. Although we recognize that the harms suffered by Janice Paul are real and not insubstantial, permitting her to recover for intangible or emotional injuries would unconstitutionally restrict the Jehovah's Witnesses free exercise of religion. The First Amendment of the United States Constitution and therefore the protections of the Washington Constitution provide the Jehovah's Witnesses' with a defense to the plaintiff's cause of action--the defense of privilege. The constitutional guarantee of the free exercise of religion requires that society tolerate the type of harms suffered by Paul as a price well worth paying to safeguard the right of religious difference that all citizens enjoy.

AFFIRMED.

Ecclesiastical abstention thus provides that civil courts may not redetermine the correctness of an interpretation of canonical text or some decision relating to government of the religious polity. Rather, we must accept as a given whatever the entity decides. See id. at 710 96 S.Ct. at 2381 (Courts "must accept such decisions as final, and as binding on [us], in their application to the case before [us].") (quoting Watson v. Jones, 80 U.S. (13 Wall.) 679, 727, 20 L.Ed. 666 (1872)). Cf. United States v. Ballard, 322 U.S. 78, 64 S.Ct. 882, 88 L.Ed. 1148 (1944) (courts will not inquire as to the truth or sincerity of religious beliefs).

This limited abstention doctrine is not relevant here because Paul is not alleging that the new rules governing disassociation are improper under Church law. (Paul has dropped her fraud claim, cf. id. at 713, 96 S.Ct. at 2382.) Nor does she seek relief for having been "wrongfully" disfellowshiped. Rather, she seeks relief for the harms she has suffered as a result of conduct engaged in by the Jehovah's Witnesses that is presumably consistent with the governing law of the Church. Accordingly, the doctrine of Serbian Orthodox Diocese does not apply.

States are, of course, free to interpret the provisions of their constitutions as being more protective of individual rights than are the comparable provisions of the federal constitution. The California Supreme Court has done so for a number of years. See, e.g., Serrano v. Priest, 5 Cal.3d 584, 487 P.2d 1241, 96 Cal.Rptr. 601, 41 ALR 3d 1187 (Cal.1971). Most recently, the Oregon Supreme Court held that all speech is protected under the state constitution including speech that would be considered obscene for purposes of the first amendment of the United States Constitution. State v. Henry, 302 Or. 510, 732 P.2d 9 (Or.1987).

Many courts have read Sherbert and subsequent cases as requiring the creation of an exemption to rules governing eligibility for public benefits where a religious person cannot, consistent with his religion, qualify for public assistance. According to this view, where an otherwise valid state regulation creates a burden on the free exercise of religion, the state is required to demonstrate both that the regulation serves an unusually important interest and that granting an exemption for the religious objector (and his coreligionists) would "do substantial harm to that interest." L. Tribe, American Constitutional Law Sec. 14-10, at 851-59. See EEOC v. Pacific Press Publishing Ass'n, 676 F.2d 1272, 1279 (9th Cir.1982); cf. Bucklund, 724 P.2d at 986 (formulating similar standard). See also Goldman v. Weinberger, 475 U.S. 503, 106 S.Ct. 1310, 1325, 89 L.Ed.2d 478 (1986) (O'Connor, J., dissenting) ("[G]overnment must show that the opposing interest it asserts is of especial importance before there is any chance that its claim can prevail [and] ... that the interest asserted will in fact be substantially harmed by granting the type of exemption requested by the individual."). We do not think the exemption inquiry undertaken in benefits cases is particularly appropriate for claims that the state is directly burdening religion by prohibiting a practice of a religious organization through the creation of substantive rules of law--be they statutory or common law. However, were we to follow the exemption approach in Paul's case, we would make the same analysis and reach the same result we do in the text. From a practical standpoint, in most free exercise cases it is of no significance which of the two methods of inquiry is employed.

            A decisão do Tribunal Federal e posteriormente a decisão da Suprema Corte, aliam-se aos ideais iluministas dos Federalistas de 1787( Jay, Madison e Hamilton), ainda com a Revolução burguesa de 1789 na França e com as idéias de Montesquieu, abraçadas pelos revolucionários de ambos os lados do Atlântico. 

            A República no Brasil foi proclamada em 15 de novembro de 1889, quando foi também instituído um Decreto, sob a orientação de Ruy Barbosa, que estabelecia a liberdade de culto e reconhecia a personalidade jurídica de todas as igrejas e confissões religiosas, mantendo,entretanto, a Igreja Católica, como a igreja oficial do Brasil, que inclusive continuava a receber subvenções.

Com o advento da Constituição Republicana de 1891, foi instituído o princípio da separação entre o Estado e a Igreja, retirando da Igreja Católica o título de religião oficial.Essa separação ocorreu mediante a influência determinante do positivismo de Augusto Comte, mas logo após essa experiência, que desvalorizava a religião nos meios políticos e sociais ao mesmo tempo em que enaltecia a ciência, o Estado brasileiro passou a restabelecer,extra-oficialmente, o consórcio com a igreja.

O princípio da laicidade do Estado impõe às organizações políticas modernas o dever de neutralidade face ao fenômeno religioso. Assim, religião deveria ser restrita à vida privada e o Estado não deveria favorecer ou prejudicar nenhum grupo religioso, apenas se limitando a respeitá-los. Tal restrição seria importante na medida em que evitaria   associações   entre   o poder político do Estado e o poder de instituições religiosas, que por tanto tempo dominaram a política brasileira, ferindo a democracia, a qual se caracteriza pelo governo de todos os cidadãos e não só de uma maioria religiosa.

No Brasil, seguidores de uma instituição religiosa que “guarda” o sábado, conhecidos como Sabatistas ou Adventistas do 7º dia, ou seja, o tem por sagrado e não trabalham ou executam atividades laborais neste dia, seus devotos,  apelam para o Art.5º inciso 6º CF/88. Vejamos um caso concreto veiculado pela mídia:

“O estudante de Direito Pedro da Cunha Barbosa, 47 anos, não poderá participar da colação de grau com os seus colegas de curso da Universidade Tuiuti do Paraná (UTP), durante a noite desta quinta-feira (21), no Teatro Guaíra, em Curitiba. Fiel da Igreja Adventista do Sétimo Dia, Barbosa foi reprovado por faltas em quatro disciplinas ao se recusar a assistir às aulas de sábado. Os adventistas não podem fazer nenhuma atividade do pôr-do-sol da sexta-feira até o pôr-do-sol do sábado.

Barbosa entrou na universidade em 2003 e diz que não teve problemas até 2006, ano em que começaram as aulas nas manhãs de sábado. Ele diz ter procurado a universidade para negociar horários alternativos, mas não teve êxito. Em outras quatro disciplinas, Barbosa contou ter conversado com os professores e foi aprovado. No ano passado, ele contratou um advogado e protocolou um mandado de segurança na Justiça Federal de Curitiba pedindo para fazer as disciplinas pendentes em outro dia e se formar junto com a turma. A liminar foi negada e o caso agora está no Tribunal Regional Federal da 4.ª Região, em Porto Alegre.

“Quero resolver a situação e me formar em Direito”, afirma Barbosa. Ele alega que a UTP se diz uma instituição laica que não quer saber de “questão religiosa”. Barbosa apela para o artigo 5.º, inciso 6.º, da Constituição Federal, que garante liberdade religiosa. “Investi cinco anos da minha energia, do meu dinheiro, e agora não vou poder me formar. Isso não é certo, nem justo”, reclama. Barbosa, que hoje atua como técnico elétrico, diz não ver o momento de pegar o diploma de bacharel em Direito, mas, de acordo com ele, a UTP não quer dialogar. “Sinto que tem não apenas uma pedra, mas uma barreira no meu caminho”, comenta.

A assessoria de imprensa da Tuiuti informou que espera a decisão da Justiça. No entanto, a assessoria observa que a UTP segue os pareceres 336/2000 e 224/2006, do Ministério da Educação (MEC), que não dão amparo legal para o abono de faltas por motivos de convicção religiosa. A celeuma ocorre por desconhecimento da lei. Os assim chamados “Adventistas do 7º dia” possuem amparo em nossa Constituição Federal, Art. 5º, incisos VI, VII, VIII, LXIX; Art. 23, inciso V; Art. 206, inciso I; Art. 208, inciso V; combinados com as Leis nº 1533/51 e nº 4348/64. A Lei Federal nº 9455/97 (que prevê inclusive pena para aqueles que usarem de coerção à liberdade de expressão religiosa contra algum cidadão brasileiro), bem como a Declaração Universal dos Direitos Humanos, no seu 18º artigo; e a Convenção Americana sobre Direitos Humanos (ambas integrantes da Legislação Brasileira, consoante Decreto nº 678/92, e CF, art. 5º, § 2º), no seu artigo 12º, também garantem ampla liberdade de expressão e fé religiosa a todo cidadão brasileiro. Há, ainda, a tramitação, após aprovação pela CCJ da Câmara dos Deputados do Projeto deLei 2.171/03, que regulamentará o direito dos alunos Adventistas, isso quando aprovado e sancionado.

São Tomás de Aquino, em sua Obra máxima, quiçá, uma das maiores expressões do conhecimento humano, a Summa Theologica[1], em seu Volume I , primeira parte, na página 3  nos diz, verbis

“Even as regard those truths about God which human reason can discover, it was necessary that man should be taught by a divine revelation, because the truth about God such as reason could discover would only be known by a few , and that after a long time, and with the admixture of many errors. But man's whole salvation, which is in God, depends upon the Knowledge of this truth. Therefore, in order that the salvation of men might be brougth about more fitly and more surely, it was necessary that they should be taught divine truths by divine revelation.”

 

            O santo não erra ao fazer a citação supra. Ao contrário , acerta maravilhosamente o alvo. Em dado local da Magnus Opus nos diz:  “Dizemos que Deus não tem nome ou está acima de qualquer denominação, porque a sua essência sobrepuja o que dele inteligimos e exprimimos pela palavra." (Aquinas , 1952- Opera cita). A questão fundamental de qualquer debate envolvendo a fé surge do fato que envolve a construção mítica do ser , na palavra de Heidegger, (Das sein), que envolve compreensão antropológica e sociológica, nisto estamos a considerar apenas o entendimento ocidental da questão religiosa.

            Ao concluir este pequeno capítulo, recorremos a uma frase de Hans Kelsen que muito revela em seu conteúdo: “A justiça é um mistério-um dos muitos mistérios da fé”. (Kelsen, “O que é justiça ?” – 2001- p.28). Começamos com Carl Schmitt e terminamos com seu mentor, Hans Kelsen. A pergunta é: Quais são os limites da justiça e do Direito ? Pensamos que  Kelsen responde inexoravelmente sobre a justiça, relacionando-a à religião, quanto ao Direito, este não conhece, uma vez positivado, sistemas deontológicos e axiológicos, a saber, diferenciamos a legitimidade da legalidade, a fé é legítima;quanto aos direitos, embora Montesquieu tenha dito que as leis possuem espíritos, a ciência jurídica não exorciza seus fundamentos.

 

 

II-           A Lei

 

O cerne da nossa reflexão e argumentação é a Lei 11.105/05, explicitamente em seu Art. 5º que transcrevemos, in verbis:

Art. 5o É permitida, para fins de pesquisa e terapia, a utilização de células-tronco embrionárias obtidas de embriões humanos produzidos por fertilização in vitro e não utilizados no respectivo procedimento, atendidas as seguintes condições:

        I – sejam embriões inviáveis; ou

        II – sejam embriões congelados há 3 (três) anos ou mais, na data da publicação desta Lei, ou que, já congelados na data da publicação desta Lei, depois de completarem 3 (três) anos, contados a partir da data de congelamento.

        § 1o Em qualquer caso, é necessário o consentimento dos genitores.

        § 2o Instituições de pesquisa e serviços de saúde que realizem pesquisa ou terapia com células-tronco embrionárias humanas deverão submeter seus projetos à apreciação e aprovação dos respectivos comitês de ética em pesquisa.

        § 3o É vedada a comercialização do material biológico a que se refere este artigo e sua prática implica o crime tipificado no art. 15 da Lei no 9.434, de 4 de fevereiro de 1997.

            O artigo supracitado da referida Lei, foi atacado pela ADI 3510/600 rel. Min. Carlos Ayres Britto, movida democraticamente pelo próprio Procurador-Geral da República, não recebendo deferimento na época, em votação polêmica e acirrada na Suprema Corte. A biotecnologia vem ganhando progresso mundo afora e, por conseguinte, as normas que a disciplinam, a integrarem o chamado Biodireito.Ao Direito não cabe impor barreiras ou estabelecer divisas morais e religiosas intransponíveis, mas sim disciplinar fatos que, inevitavelmente, venham a surgir em decorrência da evolução humana. Cabe referência à teoria do eminente e consagrado jurista alemão  Friedrich Karl von Savigny(1779-1861) e a sua concepção conhecida sobre a dinâmica do Direito: Volkgeist[2].

“Savigny, a prominent German jurist through his concept of Volksgeist introduced a new dimension in the legal arena. Savigny, also known as the pioneer of Historical school of law through his concept of Volksgeist explains the need to understand the interrelationship between law and people. Law and people cannot be isolated from each other and this is well explained by Savigny’s concept of Volksgeist.”

 

         Antes de breve reflexão sobre o Art. 2º CC/2002, vale recordar o mesmo Diploma, Código Civil vigente, ao tratar da filiação, dispõe em seu Art. 1.597, incisos III e IV, que se presumem concebidos na constância do casamento os filhos advindos de fecundação artificial homóloga, mesmo que falecido o marido, e aqueles havidos, a qualquer tempo, de embriões excedentários, decorrentes de concepção artificial homóloga.

            O que disciplina o Art. 2º do Código Civil, in verbis: “ A personalidade civil da pessoa começa do nascimento com vida; mas a lei põe a salvo, desde a concepção, os direitos do nascituro”.O eminente doutrinador Moreira Alves reflete:

 

“…não há, nunca houve, direito do nascituro, mas simples, puramente, expectativa de direito, que se lhe protegem, se lhe garantem, num efeito preliminar, provisório, numa Vorkirkung, porque essa garantia, essa proteção é inerente é essencial vã expectativa do direito… o nascituro não é titular de direitos subjetivos, não será também, ainda que por ficção, possuidor….” (José Carlos Moreira Alves, ‘Posse’, volume 1, Editora Forense, RJ, p.237)

 

Nosso Código Civil é recente, embora, apresente resquícios do Diploma Civil de 1916. A própria história democrática brasileira engatinha, é vulnerável e não apresenta raízes confiáveis. Ao pensarmos as teorias do célebre Max Weber (1864-1920) sobre a questão da ética protestante associando-a ao capitalismo, entendemos, pelo inverso da lógica, que a América latina, colonizada pela igreja Católica, apresenta dificuldades visíveis em relações sociais, econômicas e políticas ao compararmos com a América do Norte de colonização protestante. 

David Lamb, que foi conferencista de filosofia do Departamento de Ciências Biomédicas e Ética Biomética da Faculdade de Medicina da Universidade de Birminghan, Inglaterra, em seu livro “Transplante de órgãos e ética” , Editora Hucitec - 2000, nos leva a um debate mais equilibrado do ponto de vista da legislação e do compromisso social com o tema exposto. A Obra, publicada na Inglaterra em 1996, possui um Apêndice que nos brinda com a  compromissada legislação brasileira sobre transplante de órgãos:

-Lei 9.434/1997.

-ResoluçãoCFMnº 1.480/97(Conselho Federal de Medicina):

Dispõe sobre a morte encefálica.           

-Medida Provisória nº 1.718 de 6 de outubro de 1998.

-Medida Provisória nº 1.959-27 de 24 de outubro de 2000.

O debate de alto nível colocado por Lamb associa-se ao princípio, melhor, às bases colocadas por Fritz Jahr com a criação da Bioética. É imperativo que na discussão que se apresenta, o valor da vida, que Nietzsche no século XIX, dizia, “o valor da vida não pode ser avaliado”, seja colocado em primeiríssimo lugar. Lembrar-nos-emos, que a história, sobeja em exemplos de idéias que foram rechaçadas e posteriormente foram aceitas, nos coloca a proposta do jurista Savigny como ponto de início em qualquer debate sério. Klaas Woortmann[3] a pensar esta questão nos diz:

“Por um lado, já existia na filosofia medieval o princípio de que a natureza é governada pela simplicidade: Natura semper agit per vias brevissimas; natura neque redundat in superfluis, neque deficit in necessariis. Foi com base nesse princípio que Copérnico atacou o modelo ptolomaico, e ele deve ter contribuído para a aceitação da teoria copernicana. O pensamento europeu operava, de uma maneira geral, por meio de uma filosofia homocêntrica e de uma física geocêntrica. Mas Copérnico existiu no contexto do Renascimento. Do ponto de vista intelectual, o centro de interesse se deslocava para o passado, ultrapassando um aristotelismo aquinizado, descobrindo a filologia e os primórdios da arqueologia. Começara a revolução comercial e descobria-se a América. Com tudo isso, os limites do conhecimento tradicional começaram a parecer pequenos. Começava-se a duvidar que a Europa fosse o centro da mundo terrestre. Ocorria uma revolução religiosa e Roma deixava de ser o centro do mundo teológico. Instaura-se a dúvida que libera o pensamento. Nicolau de Cusa já propunha que não há nada sem movimento no universo, que este é infinito e não tem centro. Já que Londres e Paris se equiparavam a Roma e, mais do que isso, se o novo continente e o hemisfério sul eram habitados, porque não supor que a Terra e os demais corpos celestes partilhassem a mesma matéria?”

 

            Todos os debates sobre o tema são e serão bem-vindos. É preciso que em um assunto que já sabemos, o valor da vida “não pode ser mensurado” , a parafrasear Nietzsche, o cuidado com o dogma e as decisões de extremo, devem e precisam ser considerados. Como teólogo e filósofo, não é-me permitido a formação de trincheiras ideológicas sem o devido e exaustivo filtro da ciência.

A ADI  3510/600 é um exemplo da falta de diálogo entre os meios da sociedade civil. Fiz menção há pouco da tradição democrática do Brasil e isso é exponencial. A Marcha pela família e por Deus em 1964,apoiou o regime de excessão que que sob esta ideologia, usurpou o governo em 1º de abril daquele ano. O livro de David Lamb, também professor de Cambridge, em seu profundo , mostra um desnivelamento entre um meio social preparado para a discussão e outro que sequer sabe seus direitos. Paulo de Tarso, o excelente doutrinador cristão, em carta endereçada ao seu “filho na fé”Timóteo, disse: “Scimus autem quia bona est lex, si quis ea legitime utatur”[4] , ou seja, “A lei é boa se dela usamos legitimamente”.

A polêmica sobre o texto da Lei do Diploma Civil de 2002 em seu artigo 2º desagua no campo teológico e filosófico, ao Direito, cabe a normatividade e aplicação do disposto. O indivíduo não é propriedade do Estado.Embora não estejamos mais no sistema “liberal”, pelo menos vislumbramos que seus pés são de barro, onde o individualismo chegou a proporções exageradas levando ao egoísmo exacerbado e a grandes desigualdades, vivemos hoje um sistema constitucional democrático, onde se busca o constante equilíbrio entre o interesse individual e o social, e a diminuição das desigualdades sociais (ou pelo menos se deveria buscar isto para cumprir a Constituição). Desta forma surgem legítimos limites à propriedade privada sobre os mais variados bens, o que não inclui o corpo humano, por não poder estar o corpo sujeito a uma lógica do mercado, seja no perigoso e ineficaz conceito liberal , seja no conceito social. O indivíduo e sua condição de integridade e dignidade é a finalidade do sistema de direitos humanos, e não pode o Estado ignorar a sua vontade com relação ao seu corpo, a sua cultura e o seu sentimento, seja filosófico, religioso ou político, sendo que a Constituição Federal garante a sua livre manifestação de vontade.

 

Conclusão

 

A leitura em certa fase da vida, revela certos pontos que na mocidade se passaram desapercebidos. As linhas acima, longe de querer convencimento, anseiam ao menos por serem justas com alguns pensadores com quem fui injusto em leituras precipitadas. Ao saber que o tempo é o senhor da razão, prova o mármore, prova todos os sentimentos, a mim, em idade já distante dos anos que me dei nas primeiras leituras filosóficas e teológicas, acato hoje, as palavras de Thomas Hobbes, como uma espécie de esperança com relação ao futuro e especialmente ao futuro do tema que envolve os transplantes. Eu não esperava encontrar consolo no velho e rabugento monarquista que tanto critiquei, todavia, uma das coisas mais veneráveis virtudes no ser humano é saber valer-se do perdão e aplicá-lo com a consciência que em tudo há um proveito.

É provável que o tema, sequer tenha sido tangenciado, todavia, aqui , abre-se a discussão e cito Hobbes:

 

“A sabedoria assim chamada, nada mais é do que isto; o perfeito conhecimento da verdade em todos os assuntos possíveis, o qual é derivado dos registros e ralações das coisas e que se dá graças ao uso dos nomes corretos e definidos, que obviamente, não pode ser fruto de imprevista perspicácia, mas apenas da bem equilibrada razão que, ao compêndio de uma palavra chamamos de filosofia. Assim, abre-se para nós uma estrada na qual avançamos na contemplação das coisas particulares até concluirmos ou deduzirmos o resultado de ações universais.

Observemos agora, quantas espécies de coisas existem que propriamente pertencem ao círculo do que cabe à humana razão conhecer; e tais serão os ramos que brotam da árvore da filosofia e, pela diversidade de sobre o qual eles são familiarizados, foi dada a esses ramos uma vasta diversidade de nomes. Ao que trata das figuras, chamamos geometria; a física incube-se dos movimentos, a moral do direito natural e à reunião pacífica destes ramos, faz-se à filosofia, da mesma maneira que os mares britânicos, o Atlântico e o Índico, (que foram batizados conforme a diversidade das terras que banham), reúnem-se para formar o oceano. E quanto aos geômetras, estes têm verdadeiramente executado sua parte de maneira admirável. Tudo o que contribui para melhor auxiliar a vida do homem, seja devido à observação dos céus, pela forma como descreveram a terra, ou ainda pelo registro do tempo, seja finalmente devido às mais remotas experiências da navegação, em suma, todas as coisas que em nosso tempo diferenciam-se da simplicidade rude da antiguidade, devemos reconhecer que é uma dívida que temos para com a geometria. Se os filósofos da moralidade tivessem cumprido seu dever com a mesma felicidade, desconheço o que poderia ter sido somado, pela felicidade de nosso engenho, no que consiste ao gênero humano, pois se conhecêssemos a natureza dos atos humanos da mesma maneira que conhecemos a natureza da quantidade nas figuras geométricas, a força da avareza e da ambição, sustentadas pelas errôneas opiniões do vulgar sobre a natureza do Direito e da Injustiça, prontamente tornariam-se débeis e viriam a desfalecer, gozando então o gênero humano de infinita paz (a menos que seja para habitação, em suposição que a terra torne-se estreita para o número de seus habitantes), sem deixarmos a menor pretensão ou alegação que seja favorável à guerra. Mas agora pelo contrário, nem àquele que porta a espada ou a pena deveria ser permitido qualquer cessação; que o conhecimento da Lei de Natureza deveria perder seu crescimento, não avançando uma polegada além de sua antiga estatura; que os filósofos a tal ponto confrontam-se em facções diversas e hostis, que a mesmíssima ação por uns é verberada, e demasiado elevada por outros; que o mesmo homem em momentos distintos abraça opiniões distintas, e estimas suas próprias ações de maneira contrária ao que faria às ações de outros; Isto que digo, são claros signos e argumentos manifestos, que provam que tudo o que foi escrito pelos filósofos da moralidade em nada fez progredir o conhecimento da Verdade; mas, se o mundo o acolheu não foi pela luz que este lançou à compreensão, mas como entretenimento para os afetos, já que pelo sucesso de seu discurso retórico, foram confirmadas aos homens suas opiniões apressadamente aceitas. Assim, esta parte da filosofia sofreu o mesmo destino daquelas vias públicas que se abrem à todos os passageiros para travessia em todos os sentidos, como ruas abertas e estradas reais. Alguns nelas seguem por divertimento e outros por negócios, de forma que pelas impertinências de alguns e às altercações de outros, esses caminhos nunca têm um tempo para receber as sementes e sendo assim, neles nada se colhe. O argumento para esta falta de sorte deveria parecer ser isto; Que entre todos os escritores daquela parte da filosofia, não há nenhum que adote um princípio idôneo para tratá-la. Nós não podemos, como em um círculo, iniciar a manipulação de uma ciência de qualquer ponto que nos agrade. Existe um certo fio da razão que tem seu início na escuridão, mas conforme o desenrolamos nos conduz de maneira que tenha seu fim em uma luz mais clara, de modo que o princípio da doutrina deve ser extraído daquela escuridão e depois, a luz deve retornar a ela, de maneira que possa irradiar todas as dúvidas. Assim, o que é freqüente, toda vez que um escritor abandona aquela pista, seja por ignorância ou pela sua própria vontade, ele nos descreve os passos não de seu progresso na ciência, mas de suas extravagâncias que dela o afastam. Por isto, quando dediquei meus pensamentos para a investigação da justiça natural, foi anunciado pela própria palavra (que implica em uma firme vontade de dar a cada um o que é seu) de que minha primeira questão deveria ser: de onde procede que um homem queira chamar qualquer coisa como seu e não de outro? E quando achei que isto não procede da natureza, mas sim do consentimento (pois aquilo que a natureza a princípio colocará em comum, foi depois pelos homens distribuído em diversas apropriações), fui incitado por outra pergunta, a saber: para que fim, e sob que impulsos (quando tudo era igualmente comum entre os homens) os homens consideraram que fosse bastante adequado que cada um deveria ter o seu bem? Considerei que a razão foi que, se os bens fossem comuns a todos, surgem necessariamente controvérsias acerca de quem deverá extrair o maior prazer de tais bens, e das controvérsias segue-se de maneira inevitável todo o tipo de calamidades, as quais, pelo instinto da natureza, a todo homem é ensinado evitar. Tendo chegado assim a duas máximas da natureza humana, uma proveniente da parte concupiscente, que deseja destinar ao uso particular aquelas coisas nas quais todos os outros têm igual participação e interesse, o outro procedimento é racional, que ensina a todos os homens afastar-se das dissoluções que vão contra a natureza, como sendo o maior dano que se pode causar à natureza. Baseado nestes princípios, assim colocados, penso ter demonstrado por conexões evidentes, neste pequeno trabalho de minha autoria, primeiro a necessidade absoluta da existência de ligas e contratos, e com isto os rudimentos da moralidade e da prudência civil. Quanto aos acréscimos, relativos ao regimento Divino, foram incorporados com o intento de que as ordens do altíssimo Deus, na Lei de natureza, não devam parecer repugnantes à Lei escrita, a nós revelada em Sua palavra. Fui também cauteloso em todo o meu discurso, de não me intrometer no referente às Leis civis de qualquer nação particular, quer dizer, que evitei aportar em qualquer praia, ciente de que estes tempos infestaram a todas com tempestades e escolhos. Não ignoro o custo desta investigação sobre a verdade em tempo e engenho; porém, não sei avaliar seu resultado. Por sermos juizes parciais de nós mesmos, somos também parciais no julgamento de nossas produções. Eu então, ofereço este livro a seus Domínios, não a seu favor, mas sim à censura de Vossa Senhoria, como sendo de vosso julgamento por muitas experiências, não o crédito do autor, nem o zelo pelo trabalho, nem ainda o ornamento do estilo, mas apenas o peso da razão, que por seu favor me recomende sua opinião e aprovação. Se nisto a fortuna me favorecer, quer dizer, se lhe útil, se for judicioso e não for vulgar, humildemente o ofereço a Vossa Senhoria pedindo-lhe minha glória e proteção; mas se em qualquer coisa que errei, Vossa Senhoria ainda o aceitará como um testemunho de minha gratidão, visto que os meios de estudo que desfrutei por sua bondade foram consagrados em prol da obtenção de seu favor.” (Do Cidadão pp. 12-15)

 

            Estas páginas possuem personalidade epistolar, supõe-se, todavia, caso não encontrem eco, servirão para o amadurecimento do autor do artigo e para orientá-lo ainda mais na pesquisa sobre o tema. É bem sabido que a prudência em assuntos de religião é necessidade de rigor, meu respeito frente às diversas opiniões e credos não é retórica, e no dizer de Hobbes, acima transcrito, quem  ler este artigo, já terá de imediato minha gratidão.
