Justice: Lecture 02
The Lifeboat Case
Michael Sandel
What's the right thing to do?
Would you murder one person to save three lives?
Sandel introduces the principles of utilitarian philosopher, Jeremy Bentham, with a famous nineteenth century law case involving a shipwrecked crew of four.
This question arose in The Queen v. Dudley and Stephens (1884), a famous English law case involving four men stranded in a lifeboat without food or water.
After nineteen days lost at sea, the captain decides to kill the cabin boy, the weakest amongst them, so they can feed on his blood and body to survive.
How should we judge the action of Dudley and Stephens?
Was it morally justified or morally wrong?
The case sets up a classroom debate about the moral validity of utilitarianism - and its doctrine that the right thing to do is whatever produces "the greatest good for the greatest number."

Suponha que eles tenham concordado em um sorteio.
18:33How many would then say:
Quantos diriam então:
18:36It was all right.

18:37Suppose there was a lottery,
Suponha que houvesse um sorteio,
18:39cabin boy lost,
o camareiro perdeu,
18:41and the rest of the story unfolded.
e o resto da história se desenrolou.
18:51Let's hear from one of you
Vamos ouvir de um de vocês
18:57Why would it?
Por que faria?
18:59I think the essential element
Eu acho o elemento essencial
19:01in my mind that makes it a crime is
em minha mente que faz com isso seja um crime é
19:03the idea that they decided at some point
a ideia de que eles decidiram em algum momento
19:05that their lives were more important than his,

que alguém deveria morrer
19:22and it's sort of like they're all sacrificing themselves
e é como se todos se sacrificassem
19:25to save the rest...
para salvar o resto...
19:26Then it would be all right?
Então isso seria certo?
19:28A little grotesque but...
Um pouco grotesco, mas...
19:31But morally permissible?
Mas moralmente admissível?
19:34What's your name?
Qual é o seu nome?
19:36So... Matt, for you,
Então... Matt, para você,
19:47I guess you could say that
Eu acho que você poderia dizer isso
20:09is that the cabin boy was never consulted
é que o camareiro nunca foi consultado
20:14Even that with the original lottery,
mesmo aquela situação com o sorteio original,
20:16whether or not he would be a part of that.
se ele seria ou não parte disso.
20:21Right. That's what happened in the actual case.
Certo. Foi o que aconteceu no caso real.
20:23But if there were a lottery,
Mas se houvesse um sorteio,
20:25and they all agreed to the procedure,
e todos concordassem com o procedimento,
20:27you think that would be okay...
você pensa que seria certo...
20:32Whereas...
Considerando...
20:36There was no, you know, forewarning
Não havia, você sabe, aviso prévio
20:39for him to know that:
para ele saber que:
20:40"Hey, I may be the one that's dying."
"Ei, eu posso ser o que irá morrer."
20:45They have the lottery.
Eles fazem o sorteio.
20:46The cabin boy loses and he changes his mind.
O camareiro perde e ele muda de ideia.
20:54You've decided... The decision was made.
Você decidiu... A decisão foi tomada.
21:00you would, if the someone else had died,
você, se outra pessoa tivesse morrido,
21:03you know that you would consume them, so...
você sabe que você os consumiria, então...
21:06That's right.
Isso é certo.
21:07But I... But then he could say:
Mas eu... Mas então ele poderia dizer:
21:09I know, but I lost.
Eu sei, mas eu perdi.
21:12I just think that that's the whole moral issue is that
Eu só acho que a questão moral toda é que
21:14there was no consulting of the cabin boy
não houve consulta ao camareiro
21:16and that that's what makes it...
e é isso o que faz diferença...
21:22That had he known what was going on
Se ele soubesse o que estava acontecendo
21:24it would be a bit more understandable.
seria um pouco mais compreensível.
21:27Alright, good.
Tudo bem, bom.
21:28Now I want to hear...
Agora eu quero ouvir...
21:34but only about twenty percent,
mas apenas cerca de vinte por cento,
21:39led by Marcus.
liderados por Marcus.
21:42Then there are some who say
Então há alguns que dizem
21:44the real problem here is the lack of consent
o problema real aqui é a falta de consentimento
21:54Kathleen's idea:
a ideia de Kathleen:
21:55lack of consent at the moment of death,
falta de consentimento no momento da morte,
22:00and if we add consent, then,
e se acrescentarmos consentimento, então,
22:10I want to hear now, finally,
Quero ouvir agora, finalmente,
22:12from those of you who think
daqueles de vocês que pensam
22:14even with consent,
mesmo com o consentimento,
22:15even with a lottery,
mesmo com um sorteio,
22:22at the very last moment,
no último momento,
22:24it would still be wrong,
ainda seria errado,
22:28and why would it be wrong.
e por que seria errado.
22:29That's what I want to hear.
Isso é o que eu quero ouvir.
22:38and I think that
e eu acho que
22:49so there wouldn't be an act of murder,
então não haveria um ato de assassinato,
22:51but I still think that
mas eu ainda acho que
22:52even that way it's coerced
mesmo assim seria coação
22:57Like in Dudley's diary:
Como no diário de Dudley:
22:59"We're eating our breakfast."
"Estamos comendo o nosso café da manhã".
23:00It seems as though he's just sort of like: Oh!

23:38Good. Let me ask you a question:
Bom. Deixe-me fazer uma pergunta:
23:40There were three lives at stake..

23:42... versus one...
... contra uma...
23:46The one, the cabin boy, he had no family,

23:48he had no dependents.
ele não tinha dependentes.
23:53they had dependents,

Bentham diz que devemos considerar
24:04We have to add it all up.
Temos que adicionar tudo.
24:06So it's not just numbers: three against one.

25:03or in more time, three thousand...
ou em mais tempo, três mil...
25:05or suppose the stakes were even bigger.
ou suponha que os números fossem ainda maiores.
25:06Suppose the stakes were even bigger...
Suponha que os números fossem ainda maiores...
25:08I think it's still the same deal.
Eu acho que ainda é o mesmo negócio.
25:13is to add up the collective happiness?
é somar a felicidade coletiva?
25:16You think he's wrong about that?
Você acha que ele está errado sobre isso?
25:18I don't think he is wrong, but...
Eu não acho que ele está errado, mas...
25:19I think murder is murder in any case.
Eu acho que o assassinato é assassinato em qualquer caso.
25:20Yeah, but then Bentham has to be wrong.
Sim, mas então Bentham tem que estar errado.
25:22If you're right he's wrong.
Se você está certo, ele está errado.
25:23Okay, he's wrong.
Ok, ele está errado.
25:25Thank you, well done.

25:49the idea that numbers matter.
a ideia de que os números são importantes.
25:51And not only numbers matter,
E não só os números são importantes,

Parker era um órfão,
26:00no one would miss him.
ninguém iria sentir falta dele.
26:03So if you add up,
Então, se você somar,
26:25We heard an objection that said:
Ouvimos uma objeção que diz:
26:27"what they did was categorically wrong"
"o que eles fizeram foi categoricamente errado"
26:29Right here, at the end.
Aqui mesmo, no final.

26:57And if that's the reason,
E se esse for o motivo,
27:03of the larger welfare or utility or happiness?

27:06Question number one.

27:12a lottery would make a difference.
um sorteio faria diferença.
27:13A fair procedure,

27:21And some people were swayed by that.
E algumas pessoas foram influenciadas por isso.
27:24That's not a categorical objection exactly.
Isso não é uma objeção categórica exatamente.
27:27It's saying...
Está dizendo...
27:29everybody has to be counted as an equal,
todos devem ser contados como iguais,
27:32even though, at the end of the day
mesmo que, no final do dia
27:34one can be sacrificed for the general welfare.
um possa ser sacrificado pelo bem-estar geral.
27:41Why does agreement to certain procedure,

Pergunta número dois.
27:55And question number three:
E pergunta número três:
27:58the basic idea of consent.

28:00Kathleen got us onto this.
Kathleen nos levou para isso.
28:04If the cabin boy had agreed himself,
Se o camareiro concordasse,
28:08and not under duress,
e não sob coação,
28:10as was added,
como foi adicionado,
28:17And even more people signed onto that idea,
E ainda mais pessoas subscreveram essa ideia,
28:24what is the moral work that consent does?
qual é o trabalho moral que o consentimento faz?
28:39is morally permissible with consent?
é moralmente permissível com o consentimento?
28:45To investigate those three questions,

28:47we're going to have to read some philosophers.
